The Supreme Court upheld the validity of sub-rule 3 of Rule 3 of the Sugarcane (Control) Order, 1955, stating that it is enforceable under Section 3 of the Essential Commodities Act, 1955, which applies to food crops. The Court rejected the argument that the Bihar Sugar Factories Control Act, 1937, precluded Parliament's authority to legislate on sugarcane pricing, affirming that Parliament has the competence to regulate foodstuffs under Entry 33 of List III of the Constitution. The Court also ruled that there was no violation of Article 19(1) as there is no fundamental right for a buyer to delay payment for goods purchased.
