Judgment text excerpt

The Supreme Court held that the rights of the Girasdars were not extinguished under the Saurashtra Land Reforms Act, 1951, and that the court had jurisdiction under the Saurashtra Agricultural Debtors Relief Act, 1954 to scale down debts and restore possession of mortgaged lands. The Court clarified that the Land Reforms Act aimed to regulate landlord-tenant relationships and did not affect the rights of mortgagors unless tenants were established by contract or law. The appellants failed to prove that they had become tenants, and thus their occupancy rights did not extinguish the respondents' title.
