Judgment text excerpt

The Supreme Court held that under Section 14(1) of the Arbitration Act, 1940, a notice of the making and signing of an award can be satisfied by sending a copy of the signed award to the parties, which constitutes sufficient notice for the purpose of limitation. The Court clarified that the absence of a separate notice or the omission of fee details does not invalidate the notice. Consequently, the appellant's application for passing a decree based on the award was deemed out of time as it was filed beyond the stipulated period under Article 178 of the Indian Limitation Act, 1908.
