The Supreme Court held that the terms 'Superintendent of Police' and 'District Superintendent of Police' refer to the same authority under the Police Act, 1861, and the Punjab Police Rules, 1934. It ruled that the Superintendent of Police for the City of Delhi had the jurisdiction to dismiss the respondent, a Sub-Inspector, and that the officer conducting the inquiry was competent as he was a superior officer. The Court also found that despite the destruction of the inquiry file, oral evidence confirmed that the prescribed procedures under Rule 16.38 were followed, thus upholding the dismissal.
