The Supreme Court held that applications under Sections 8 and 20 of the Arbitration Act, 1940 are not subject to the limitation prescribed in Article 181 of the Limitation Act, 1908. The Court clarified that the absence of an amendment to Article 181 by the Legislature indicates that no limitation applies to such applications, thereby allowing the appellant's application which was previously dismissed by the High Court. The Court concluded that the Limitation Act does not prescribe any period of limitation for applications under the Arbitration Act, 1940.
