The Supreme Court held that under Section 3(1) of the U.P. (Temp.) Control of Rent and Eviction Act, 1947, if the State Government sets aside the Commissioner's order revoking permission, the original permission to institute the suit is revived. The Court affirmed that the landlord had valid permission to file the suit from July 30, 1963, and thus the decree passed on March 2, 1964, was maintainable. The appeal was dismissed, upholding the decisions of the lower courts.
