The Supreme Court held that under the Abolition of Proprietary Rights (Estates, Mahals Alienated Lands) Act, 1950, the forest and trees vested in the State, thus the appellant did not acquire ownership of the timber as goods under the Sale of Goods Act, 1930, Section 19. The Court found that the trees had not been ascertained goods prior to being felled, and the appellant's reservation of rights in his acceptance letter meant there was no concluded contract. Consequently, the appeal was dismissed, affirming the High Court's decision.
