The Supreme Court held that the East Punjab Factories (Control of Dismantling) Act, 1948, does not bar the delivery of possession in execution of a decree for possession against the owner of a factory. The Court clarified that the execution of a decree does not equate to dismantling a factory, and thus, the executing court's order for possession does not infringe the provisions of the Act. The appeal was allowed, affirming that the earlier decisions did not render the decree inexecutible under the Act.
