The Supreme Court held that under Section 16(3) of the Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1962, the right of reconveyance does not accrue until the registration of the sale deed is completed, which occurred on 30th November 1964. The Court clarified that the application filed on 26th November was premature as the transfer had not been completed by that date. The Court upheld the Collector's order granting possession to the appellant but ultimately ruled that the Board of Revenue's decision to set aside the Collector's order was valid, leading to the dismissal of the appellant's writ petition.
