The Supreme Court held that the High Court erred in concluding that the contracts for construction were fully performed, thereby not applying Section 9A of the Representation of the People Act, 1951. The Court established that even if some work remained to be completed or defects needed repair, the contracts were still considered subsisting under Section 9A, disqualifying the first respondent from election. Consequently, the Court declared the first respondent's election void and the appellant elected due to the votes cast for the first respondent being treated as thrown away.
