Judgment text excerpt

The Supreme Court held that the relinquishment of the Tanjore Raja's properties by the Government of India in 1862 constituted a fresh grant, thereby confirming that the Tanjore Palace Estate qualifies as an 'estate' under Section 3(2)(d) of the Madras Estates Land Act, 1908. The Court found that Orathur Padugai was indeed a whole village, thus meeting the definition of 'estate'. Furthermore, the lands in question were classified as 'ryoti lands' rather than 'private lands', as defined in Section 3(10)(b) and Section 3(16) of the Act, indicating that the defendants had occupancy rights therein. The appeals were dismissed, affirming the lower court's decisions.
