Judgment text excerpt

The Supreme Court held that after the amendment by Act 27 of 1956, there is no prohibition under Sections 33 and 36 of the Representation of the People Act, 1951 against an elector proposing more than one candidate in a single-member constituency. The Court ruled that the rejection of nomination papers of two candidates for unnecessarily filling the caste column was incorrect, as there is no explicit rule forbidding such mention. Consequently, the High Court's decision to void the election was overturned, and the appeal was dismissed.
