The Supreme Court upheld the High Court's decision that the respondents, teachers in District Board Schools, were confirmed in their posts after the completion of the three-year probation period as per Rule 6(3) of the Punjab Educational Service (Provincialised Cadre) Class III Rules, 1961. The Court ruled that the continued service without an express confirmation order implied confirmation, and the termination of their services without a departmental inquiry violated Article 311 and the Punjab Civil Services (Punishment and Appeal) Rules, 1952. Thus, the impugned orders were set aside.
