The Supreme Court held that the appellant, who was appointed to the Indian Police in 1937, became a member of the Indian Police Service under the Indian Police Service (Recruitment) Rules, 1954, and thus was subject to the All India Services (Discipline and Appeal) Rules, 1955. The Court rejected the appellant's contention that the Bihar Government lacked authority to order an enquiry against him, affirming that he was a member of a regularly constituted service at the time the rules came into force. The appeal was dismissed, upholding the validity of the suspension and enquiry orders.
