The Supreme Court held that under Section 100(1)(d)(iv) of the Representation of the People Act, the election petitioner must prove that the election result was materially affected by irregularities. In this case, although the Judicial Commissioner found that the election was conducted in contravention of the Act, the petitioner failed to demonstrate that the result was materially impacted, as the evidence presented was speculative and insufficient. Consequently, the appeal by the returned candidate was allowed, affirming the election result.
