Judgment text excerpt

The Supreme Court held that the award of the Industrial Tribunal was applicable only to the workmen of the appellant company's factory at Jamshedpur, as the disputes referred were specifically between the management of that factory and the workmen represented by the Indoxco Labour Union. The Court ruled that overtime payment should be at 1.5 times the ordinary rate for work exceeding 39 hours but not exceeding 48 hours per week, and double the ordinary rate for overtime exceeding 48 hours. The demand for special leave with pay for union representatives to attend law courts was rejected, but special leave for attending union meetings was granted.
