The Supreme Court held that under Section 47(3) of the Motor Vehicles Act, 1939, existing operators do not have an express right to be heard by the Regional Transport Authority before an order is made, but they do have an implied right to seek revision under Section 64A if aggrieved by such an order. The Court clarified that the High Court erred in dismissing the writ petition without directing the State Transport Authority to consider the merits of the revision petition. However, due to the time elapsed since the order, the Court refrained from interfering under Article 136.
