Judgment text excerpt

The Supreme Court upheld the constitutionality of Section 12 of the Displaced Persons (Compensation and Rehabilitation) Act, 1954, ruling that it does not violate Articles 14 and 19(1)(f) of the Constitution. The Court found that the appellant had no rights in the property that vested in the Central Government, and thus could not claim protection under Article 19(1)(f). Additionally, the amendment to Section 10(2)(m) of the Administration of Evacuee Property Act, 1950, did not alter the Custodian's powers regarding the payment of evacuee debts, affirming the legal position remained unchanged.
