The Supreme Court held that under Section 13(1)(e) of the Delhi and Ajmer Rent Control Act, 1952, a landlord can only evict a tenant if the premises are let out solely for residential purposes. The Court ruled that the tenancy was a single, indivisible contract and that the High Court's order to demarcate residential and non-residential portions for eviction was without jurisdiction. Consequently, the High Court's order was set aside, reaffirming that eviction cannot be granted for part of a property used for residential purposes when the entire property is let for composite use.
