The Supreme Court held that under Section 19(6) of the Industrial Disputes Act, 1947, a Tribunal lacks jurisdiction to consider matters covered by a subsisting award unless that award has been terminated. The Court found that the earlier award in I.C. 11 of 1955 had not been properly terminated by the workmen's letter dated June 26, 1961, as it did not convey the intention to terminate. Consequently, the reference made by the State Government in 1963 was incompetent, and the Tribunal's decision was upheld, affirming the binding nature of the earlier award.
