The Supreme Court held that the entry in the Khasra of 1356 Fasli did not meet the requirements of Section 20(b) of the U.P. Zamindari Abolition and Land Reforms Act, 1951, as 'P' was not properly recorded as an 'adhivasi'. The Court found that the appellants failed to establish 'P's actual cultivatory possession under Section 3 of the U.P. Land Reforms (Supplementary) Act, 1952. Consequently, the High Court's decree for possession in favor of the respondents was upheld, affirming the jurisdiction of civil courts in such disputes despite the appellants' claims.
