Judgment text excerpt

The Supreme Court interpreted Section 28 of the Bombay Public Trusts Act, 1950, and Section 88B of the Bombay Tenancy and Agricultural Lands Act, 1948, determining that trusts registered under the Madhya Pradesh Public Trusts Act, 1951, are not automatically deemed registered under the Bombay Act unless they are situated in Maharashtra. The Court held that the appellant's trust, primarily administered in Madhya Pradesh with only a small portion of property in Maharashtra, does not qualify for the exemptions under the Bombay Act. Thus, the High Court's decision against the appellant was upheld.
