The Supreme Court held that under Section 14(2) of the Road Transport Corporation Act, 1950, the Corporation has the incidental power to appoint officers and servants necessary for efficient performance, despite the absence of regulations under Section 45(2)(c). The Court clarified that while appointments must conform to any directions from the State Government under Section 34 and regulations under Section 45(2)(c), the Corporation can still make appointments on terms it deems fit until such regulations are established. The appeal was allowed, overturning the High Court's decision that had quashed the appointment notice.
