The Supreme Court held that under Hindu law, a joint tenancy is not recognized except in coparcenary situations. In this case, the will of a childless Hindu lady granted life estates to her foster children, B and K, with a vested remainder to their children. The Court affirmed that B and K inherited as tenants in common, and their descendants would inherit per stirpes, not per capita, thus upholding the decisions of the lower courts.
