The Supreme Court held that Section 73A of the Bombay Industrial Relations Act, 1946 does not violate Article 14 of the Constitution, as it provides a mechanism for unions to refer disputes to the Industrial Court, compensating for the employer's ability to refuse arbitration under Section 66. The Court also ruled that Chapter V of the Bombay Industrial Disputes Act, 1938 is not repugnant to the Central Industrial Disputes Act, 1947, thus affirming the applicability of the Bombay Act to the cotton industry in Ahmedabad without the need for a notification under Section 2(4). The appeal was dismissed, upholding the Industrial Court's decision.
