The Supreme Court examined the Income-tax Service-Seniority Rules, 1952, particularly Rule 1(f)(iii) and (iv), and held that the promotion rules creating a distinction between direct recruits and promotees violate Articles 14 and 16 of the Constitution. The Court established that the fixation of seniority based on different periods of service for direct recruits and promotees is discriminatory. Consequently, the Court ruled that the promotion rules must be amended to ensure equality in seniority, leading to the invalidation of the existing seniority provisions.
