The Supreme Court held that the customary law among the Sidhu Jats of Muktsar Tahsil regarding non-ancestral property favors daughters over collaterals in succession. The Court found that the entries in the Riwaj-i-am did not pertain to non-ancestral property and thus could not establish a special custom that would allow collaterals to exclude daughters. The appellants failed to prove that the general custom recorded in Rattigan's Digest was varied by any special custom, affirming the High Court's decision in favor of the daughter.
