The Supreme Court ruled that Section 17(1) of the Industrial Disputes Act, 1947, mandates the publication of an award by the appropriate Government but the time frame of thirty days for such publication is directory, not mandatory. Consequently, the award published on 15th November 1966, after being received on 14th October 1966, remains enforceable. The Court clarified its stance by explaining previous observations in The Sirsilk Ltd. case and followed the precedent set in The State of Uttar Pradesh & Others v. Babu Ram Upadhya.
