Judgment text excerpt

The Supreme Court ruled that the detention orders under Rule 30(1)(b) of the Defence of India Rules, 1962, were invalid due to non-compliance with the requirement for a quasi-judicial review as established in P.L. Lakhanpal v. The Union of India, which overruled the previous decision in Sadhu Singh v. Delhi Administration. The Court held that the failure to provide an opportunity for the petitioners to represent their cases rendered the continued detention illegal. Consequently, the writ petitions were allowed, and the petitioners were ordered to be released.
