The Supreme Court held that the notification by the Railway Board, which favored apprentice train examiners for promotion to Grade 'C' over promotees from Grade 'D', violated Articles 14 and 16 of the Constitution of India. The Court established that once both categories were merged into one cadre, they could not be treated differently for promotions, as this constituted discrimination. The Court ruled in favor of the petitioner, declaring the notification arbitrary and discriminatory.
