The Supreme Court held that in a domestic enquiry under Section 33(2)(b) of the Industrial Disputes Act, 1947, if an employee admits the charges against him, the management may examine him first to allow for explanations or mitigating circumstances. The Court clarified that while the rules of natural justice must be observed, in cases of admission, the management is not required to present further evidence regarding the allegations. The Labour Court's decision to reject the discharge of the employee was found to be incorrect, and the appeal by the bank was allowed.
