The Supreme Court ruled that the latter part of Rule 9(2) of the Mysore Recruitment of Gazetted Probationers’ Rules, 1959, which allows the State Government to appoint candidates to any cadre based on perceived suitability, is violative of Articles 14 and 16(1) of the Constitution. The Court held that candidates have a right to be appointed based on their rank in the merit list, and the State Government cannot withhold appointments arbitrarily. Consequently, the High Court's directive for the Government to appoint the respondent as Assistant Commissioner was deemed appropriate.
