Judgment text excerpt
The Supreme Court examined Section 18 of the Suppression of Immoral Traffic in Women and Girls Act, 1956, determining that it does not violate Article 14 of the Constitution as it establishes a reasonable classification for cases. However, the Court held that the Sub-Divisional Magistrate's actions were invalid as he failed to address the cognizable offences under Sections 3 and 7, which necessitated a proper trial and appeal process. Consequently, the Court set aside the Magistrate's orders and mandated adherence to the Criminal Procedure Code for such cases.
