The Supreme Court held that under Section 173 of the Punjab Municipal Act, 1911, the Municipal Committee has the authority to regulate the sale of food on public streets, particularly to prevent obstruction and insanitary conditions. The Court ruled that the Prevention of Food Adulteration Act, 1954 does not limit the powers of the Municipality to prohibit street trading if it creates unhygienic conditions. The Court concluded that while street vendors may have a right to trade, it is not absolute and must be balanced against public health and safety concerns.
