The Supreme Court held that under Section 6 of the Bombay Land Requisition Act, 1948, the State Government has the authority to requisition vacant premises, and an assignment of tenancy rights can be deemed to create a vacancy, thus allowing for requisitioning. The Court clarified that Section 15 of the Bombay Rents, Hotel and Lodging House Rates Control Act, 1947 does not limit the powers granted under the Requisition Act. The petition challenging the requisition on constitutional grounds under Articles 19(1)(f) and (g) was dismissed, affirming the validity of the requisitioning process.
