Judgment text excerpt
The Supreme Court held that the custom of divorce among the Jats of Jullundur District allows a divorced woman to remarry during the lifetime of her first husband, based on evidence from surrounding districts. The Court found that the Rattigan's Digest was not helpful in establishing this custom, and the Riwaj-i-Am was deemed unreliable. Consequently, the High Court's ruling that Mst. Angrez Kaur's marriage to Sunder Singh was valid, and her entitlement to his property was upheld, as her divorce from Tarlok Singh was valid under the established custom.
