Judgment text excerpt

The Supreme Court held that under Section 14 of the Hindu Succession Act, 1956, a Hindu widow who was dispossessed of her husband's property retains her rights as a full owner, even if she is not in actual possession at the time the Act came into force. The Court affirmed the first appellate court's finding that there was no karewa marriage, which was binding on the defendants, and ruled that the widow's daughter inherited the property upon her death. The High Court's dismissal of the defendants' appeal was upheld.
