The Supreme Court held that under Section 93 of the Madras Hindu Religious and Charitable Endowments Act, 1951, no trustee can be discharged from liability without rendering accounts of their management, irrespective of negligence or willful default. The Court found that the High Court's ruling, which barred the maintainability of the suit due to the absence of such allegations, was incorrect. The Court affirmed that the suit for rendition of accounts by the present trustees against ex-trustees was maintainable, as the section does not restrict suits under general law not covered by the Act.
