The Supreme Court held that the deletion of Section 29 of the Calcutta Thika Tenancy Act, 1949 by the Amendment Act of 1953 does not affect pending proceedings and does not deprive the Controller of jurisdiction to try such matters. The Court ruled that under Section 8 of the Bengal General Clauses Act, 1899, the lawful transfer of the suit under Section 29 remains valid despite its deletion. Furthermore, the Thika Tenancy Act imposes restrictions on landlords' rights to evict tenants, thus reinforcing tenant protections under the law.
