Judgment text excerpt

The Supreme Court held that under the Land Acquisition Act, 1894, particularly Sections 11, 18, and 28, the compensation for acquired land must reflect its market value, which can be established through genuine offers to purchase. The Court found that the High Court erred in rejecting the Deputy Collector's offer as non-genuine, and thus, the compensation should be based on Rs. 18,000 plus a 15% solatium. Additionally, the Court ruled that interest under Section 28 cannot be awarded at a rate lower than 6% without proper justification, thereby setting aside the High Court's decision on interest.
