Judgment text excerpt
The Supreme Court upheld the Daman (Abolition of Proprietorship of Villages) Regulation, 1962, determining its constitutionality under Article 31-A of the Constitution. The Court ruled that lands used for agricultural or horticultural purposes vest in the Government with compensation, while other lands such as hilly areas and salt pans do not vest under the Regulation and require separate compensation assessment. The Court clarified that the definition of 'estate' under Article 31-A(2) does not apply to the lands in Daman as they were not held under a tenure system recognized by Indian law.
