Judgment text excerpt

The Supreme Court held that under Section 116-A of the Representation of the People Act, 1951, an appeal to the High Court does not require a decree from the Election Tribunal, but only a copy of the Tribunal's judgment. The Court clarified that the Tribunal's order under Section 98 does not necessitate a decree, and a memorandum of costs suffices. Additionally, the Court ruled that Rule 73(2) of the Conduct of Election Rules, 1961, does not mandate the use of Arabic numerals for marking preferences on ballot papers, thus validating votes marked with Roman numerals.
