The Supreme Court held that under Section 10(1) of the Bihar Land Reforms Act, 1950, the head lease of 1928 was deemed to be a lease by the State Government upon the vesting of the Palganj estate. The Court clarified that the terms of the lease remained unchanged except for the modification powers under the Mines and Minerals (Regulation and Development) Act, 1957. The Court upheld the validity of the statutory lease and ruled that the Controller's termination of the lease was invalid as it was protected under the Bihar Act.
