The Supreme Court interpreted Section 13(3)(a)(ii) of the East Punjab Urban Rent Restriction Act, 1949, holding that a landlord can only seek ejectment of a tenant if the land is required for business or trade purposes, not merely for personal use such as constructing a residential house. The Court overruled the previous decision in Municipal Committee, Abohar v. Daulat Ram, I.L.R. [1959] Punjab 1131, which allowed for ejectment for any personal use. The appeal was allowed, and the order of ejectment was set aside.
