Judgment text excerpt

The Supreme Court upheld the seniority list of Assistant Controllers, ruling that the appointments made on an ad hoc basis were not intended to be permanent and did not confer any rights to the petitioners. The Court clarified that the ratio of 75% direct recruits to 25% promotees, established under Article 309, was valid and not retrospective, thus not violating Articles 14 and 16 of the Constitution. The Court held that the petitioners, having been appointed temporarily, had no legitimate claim to seniority over the direct recruits.
