Judgment text excerpt

The Supreme Court interpreted item 40 of Part 13 of the Scheduled Castes Order, 1950, clarifying that 'Sunris excluding Sahas' means individuals of the Sunri caste, excluding only those from the Sahas subgroup, and not excluding members of the Sunri caste who bear the surname Saha. The Court held that the respondent failed to prove that the appellant was not a member of the Scheduled Caste, thus affirming the appellant's election to the West Bengal Legislative Assembly. The High Court's decision to invalidate the election was overturned.
