Judgment text excerpt

The Supreme Court held that under Order 20, Rule 12 of the Civil Procedure Code, 1908, the court has the authority to grant decrees for both past and future mesne profits in a suit for recovery of possession of immovable property. The Court affirmed the findings of the High Court regarding the respondents being the next reversioners of N and the invalidity of the will executed by C. The decree for mesne profits was upheld, allowing the respondents to recover profits for three years prior to the suit and future profits as determined by the Trial Court.
