The Supreme Court held that under Section 24 of the Patiala and East Punjab States Union Holdings (Consolidation and Prevention of Fragmentation) Act 5 of 2007 BK, a pre-emptor has the right to follow land allotted in consolidation proceedings that replaces the original land subject to pre-emption. The Court affirmed that the right of pre-emption extends to the newly allotted land, thereby preserving the obligations attached to the original holding. The appeal by the appellants was dismissed, upholding the lower courts' decisions.
