The Supreme Court held that under Section 185(1) of the Madhya Pradesh Land Revenue Code, 1954, the appellant's father, M, became an occupancy tenant upon the Code's commencement. The court clarified that the status of the respondent at the time of the Code's commencement, not at the time of the lease, determines eligibility for occupancy tenant status. Since the respondent was no longer a minor at the Code's commencement, he did not belong to the disabled class as defined in Section 168(2), leading to the dismissal of the respondent's suit for ejectment.
