Judgment text excerpt

The Supreme Court ruled that when a notification under Section 6 of the Land Acquisition Act, 1894 is found to be invalid, the Government has the authority to issue a fresh notification under the same section. The Court clarified that Section 48 does not prevent the Government from doing so, and the cancellation of the earlier notification merely acknowledges its invalidity. Consequently, the appeal against the Gujarat High Court's dismissal of the writ application was rejected, affirming the validity of the new notification.
